Juvenile Record Sealing
Welfare and Institutions Code Section 781 permits persons who acquired records as juveniles to petition the juvenile court to have those records sealed.
Eligibility Requirements (Pursuant to W&I 781):
Situations where the court automatically seals your records:
If your case is dismissed by the juvenile court after January 1, 2015 and you were not found to have committed an offense listed in the Welfare and Institution code section 707(b), and the court finds that you have completed your probation successfully, the court will seal your records automatically.
For all other situations you will need to ask the Court to seal your records and meet the eligibility requirements pursuant to W&I 781
For those who HAVE been on probation and probation was terminated in San Bernardino County:
You have reached the age of 18 years
There is no true findings of a felony after the age of 14 for an offense described under the Welfare and Institution Code 707(b)
There is no conviction of any misdemeanor involving moral turpitude OR any felony convictions in adult court, unless the conviction has been set aside pursuant to Penal Code Section 1203.4
Rehabilitation has been attained to the satisfaction of the court (not currently on supervised probation)
There is no current pending civil litigation directly relating to, or arising from, the criminal act that cause records to be created.
For those who have NOT been on probation:
No Juvenile Court Petition filed for five years or more after you were cited to appear
Before a probation officer OR
Were taken before a probation officer pursuant to Section 626 OR
Were taken before any officer or a law enforcement agency OR
At any time after you reached the age of 18 years

Costs:
Two (2) separate payments are required:
$82.00, paid to the Probation Department, 150 West 5th Street, San Bernardino, CA 92415. The $82.00 fee is non-refundable. If you completed the Youth Accountability Board, this fee will be waived.
$25.00 payable to Juvenile Traffic Court, 900 E. Gilbert Street, San Bernardino, CA 92415. Payments must be made by money order or cashiers check only. Personal checks will not be accepted (authorized by Welfare and Institutions Code 903.3).
The San Bernardino County Probation Department Process:
Pre-Court:
Upon receipt of all necessary documents, the probation department will conduct an investigation to determine eligibility. The probation department will petition the court to seal all records. The applicant will then receive a Notice of Juvenile Court Hearing on Petition to Seal Records by mail. You are not required to appear, this is a Non-Appearance Review Hearing.
Post-Court:
After the judge has approved the sealing and signed the Order to Seal Records, the court will send a copy of the signed order and a letter of explanation to you.
After all agencies named in your record have complied with the Order to Seal Records, it is as if your record never existed.
